Abstract
There are few studies on the jurisprudential and legal development of the man as the head of the family serving prison in the country. Therefore, the question is what is the position of the Constitutional Court on the matter? From the development of the subject, it is found that society and the family have had great changes and that man can currently fulfill roles that in ancient times were clearly of the female orbit. For this reason, it is vital that legislation in this regard is exclusively for men and that the law is not applied by analogy, because to protect the female head of the family there is sufficient recognition. This research has a qualitative research approach.
