Estándares internacionales en la aplicación de algunos modelos de investigación y acusación en el marco de justicia transicional en Colombia
Abstract
The present study is aimed at identifying international standards in the application of some models of investigation and accusation regarding the framework of transitional justice in Colombia.- MODEL OF JSTICIA WHICH is constituted by a set of processes of social transformation that imply mechanisms or actions to reach an end, as well as the inclusion and execution of participatory political changes as a basic element for the existence of transitional justice; which aims to face massive violations of human rights committed by the participants in a conflict and in the same way achieve a reconciliation that leads to stability as the balance that arises between the tensions that exist between justice and peace. Now, transitional justice speaks of standards to indicate parameters, rules or guidelines that must be taken into account by the States or communities that intend to move from a situation of conflict, authoritarianism or repression, to one in which peace and justice prevail. Democracy. The materialization of the standard in the application of a model of transitional justice occurs when the contents and levels of enforceability of the rights to truth, justice and reparation are specified, together with the commitment of non-repetition of the facts. methodology used in the work was directed to the analysis and interpretation of both local and international documents; studies of documents of peace agreements made in Colombia, doctrine and jurisprudence of international courts.- The main result of this work is the observation resulting from the model implemented in Colombia in terms of special justice and the tension that is generated against the historical model of solving the social conflict that has guided the development of the country and facing new theoretical trends .The main conclusion that stands out from this work, is framed in the imperative need that requires the structured model in Colombia and that surrounds the framework of the special jurisdiction, to be brought clearly and objectively to the different levels of society; in such a way that the theoretical concepts are not only of management in political sectors but that this conception flows from the foundations in the education of each citizen in our country and that in the stipulated times peace can be materialized with this group apart from the law; process that in its way will open the doors for the inclusion of other postulates.
